 i was just wondering if i can make a TCM or total conversion mod and distribute the mod and the game under a different name if not then o well thank you for your time.

Of course you can, everything's under the GPL. So, provided you release things under the GPL as well, everything's all good. If you do this, then you're required to change the name. Still, get a response from one of the main OA guys since I'm no one to give such a call, maybe dmn_clown or leileilol.
